After that testimony, a judge ruled there is enough evidence to send Flemister to trial on attempted homicide charges.
Police say the incident was a botched robbery, and that Dowling, an accused drug dealer, was the intended target. Rodriguez is also accused of attempted murder. Police say he and Flemister planned the home invasion together.
Rodriguez waived his preliminary hearing and was prepared to testify against Flemister, according to his attorney.
Karl Rominger said his client never wanted anyone to get hurt, and has cooperated with authorities.
"Had the young lady who testified not been able to get out the entire story because of memory or emotion, he was ready willing and able to be called to the stand," Rominger said. "He's as horrified and shocked by this incident as she (Keller) was."
Prosecutors say Keller's testimony was convincing.
"She remembers that face, she remembers Vincent Flemister," said prosecutor Jon Birbek. "She knows he's the man that shot her fiancee."
On the stand, Keller said Newell's spine was severed by the bullet. She said he is paralyzed and doctors have said the paralysis will be permanent.
Rodriguez and Flemister remain behind bars on $250,000 bail.

So who is going to surrport this brave young man for the rest of his life. Where are the funds going to come from. I pose that his brother (because of his tie in this) and the guy who shot him (once it is settled) have to make surport payments for the rest of the young mans life. Some how it must be figured for these two to pay more than just jail time.
