It was a legal defeat for 48 year-old Robert George Henry of Fannettsburg, Franklin County.
Despite his argument that smoking pot every day helps him better communicate with God, drug charges filed against him will stick.
He wanted those charges dismissed, because of his religious beliefs. Cumberland County President Judge Edgar Bayley denied the request.
Henry was pulled over in Cumberland County in October. Court documents show officers found bags of marijuana and cash in his car.
He testified that he smoked pot just 30 minutes before getting behind the wheel.
But Henry says he's a member of the Hawaii Cannabis Ministry, which celebrates the use of pot as a religious sacrament.
But on the stand, Henry admitted he didn't join that church until January 2008 - months after his arrest.
Henry will return to court next month.
